ACCEPTABLE USE POLICY

Policy Overview

We are happy to be providing you with high quality and reliable telecommunications services (the “Services”). But while we certainly want you to leverage these Services for your business purposes in the course of normal operations, there are certain activities that we do not permit you to do while using our Services and infrastructure (collectively, our “Facilities”). This is to ensure that we are able to provide exceptional service to you and to our other customers and to ensure that our Facilities are used in an appropriate, legitimate and lawful manner. We see this as a team effort involving the participation and support of all individuals and organizations that use our Facilities.

Third Party Use

You are responsible for the use of our Facilities by any third party through any access that we provide you, whether or not you have authorized such use.

In addition, this acceptable use policy (the “AUP”) applies to any of our content or data (collectively, “Content”) or e-mails sent by you or on your behalf (including but not limited to automated responses such as from a chatbot).

Unacceptable Activities

We want to make sure that you are using our Facilities appropriately. To that end, you are not (directly or indirectly, through a third party) permitted to use our Facilities in any illegal or harmful manner including but not limited to:

Content:

Transmitting or posting hateful, harassing or defamatory messages or any Content that is obscene, child pornography or hate material.
Transmitting, publishing or reproducing Content (including software) that is confidential or proprietary to a third party without prior authorization.
Using the Facilities in a manner that constitutes an invasion of privacy, appropriation of personality, stalking, harassment or unauthorized linking or framing.
Publishing, distributing, transmitting, selling or making available through the use of the Facilities intimate images of a person or persons without their consent.

Network Access and Security:

Using the Facilities in a manner designed to circumvent user authentication, network security or to permit fraudulent use of our Facilities or the networks of other parties.
Posting or transmitting any information or software which contains a virus, "cancelbot", "trojan horse", "worm" or other harmful or disruptive component.
Using the Facilities or distributing tools for the purposes of harming or gaining unauthorized access to our or other networks including but not limited to denial of service attacks, security vulnerability probing, and network trespass.
Attempting to gain access to any other person’s computer, software or data, without their knowledge or consent.

Other Prohibited Activities:

Using the Facilities to conduct any illegal or immoral activities including but not limited to pyramid selling, fraud and illegal gaming or which involve an unreasonable burden on our Facilities such as cryptomining.
Promoting or facilitating the transmission of unsolicited email messages.
Creating a false identity such as altering or spoofing the headers of your email messages in any way.
Exporting any equipment that we provide you other than as we may authorize.

Compliance

In order to ensure compliance with the terms of this AUP, we may investigate incidents or complaints involving suspected or actual violations of the AUP, and such violations may subject you to civil or criminal liability. In the event of a criminal violation, we will co-operate fully with law enforcement. Such co-operation may involve disclosure of information about your violation of the terms of this AUP to law enforcement authorities as well as with other on-line service providers where required to ensure compliance or to remedy or mitigate the effect of your breach of these terms.

You agree to defend, indemnify and hold us and our directors, officers, employees, affiliates and our service providers harmless from and against any loss, cost (including reasonable lawyer and court costs), damage, injury, liability, claim, penalty, fine, interest, or any cause of action whatsoever resulting howsoever from your breach of the terms of this AUP.

Remedies Available to Us

If you engage in any of the unacceptable activities described in this AUP, we may at our sole discretion (1) restrict, suspend or terminate your use of or access to our Facilities, (2) delete any of your Content that is stored or hosted on our Facilities, or (3) block or filter any Content you post or otherwise transmit using our Facilities. You will also be responsible for any fees and service charges applicable to our exercising of these rights (including but not limited to disconnection fees). Any violation of this AUP will also constitute a violation of the terms of your Service Agreement with us and may result in the termination of your Service Agreement.

If we suspect a violation of this AUP, we will notify you of the violation before taking any further steps except in the event of an emergency (e.g. an imminent harm to our Facilities) in which case we may be required to take action without prior notice to protect our Facilities.

Using our Facilities Safely

While we make every effort to implement safeguards to protect our Facilities so that you can enjoy them in a safe manner, we cannot guarantee that use of our Facilities will be error-free or risk-free. You should take reasonable precautions on your own as well to protect your security when using our Facilities. These precautions include using anti-virus and anti-malware software on your devices, not installing unknown or suspicious programs to your devices and not providing personal information over an unsecure network where possible.
